Ride Operator Due in Court Over NC Fair Injuries

A ride operator is due in court Monday to face criminal charges after five people were injured at the North Carolina State Fair.
Ride operator Timothy Dwayne Tutterrow, 46, of Quitman, Ga., faces three criminal counts of assault with a deadly weapon in the mishap. Tutterrow was being held in jail Sunday on $225,000 bond and due in court Monday for a first appearance. His attorney says he's devastated.
Three people injured on the ride were in a Raleigh hospital on Sunday. On Thursday, the "Vortex" ride suddenly jolted into gear as people were exiting, dropping some riders from heights that eyewitnesses estimated to be 20 or 30 feet.
Wake County Sheriff Donnie Harrison said investigators determined the Vortex had been tampered with and critical safety devices were compromised. |

Chile top court confirms block on Barrick mine

Chile's Supreme Court confirmed on Wednesday the suspension of Barrick Gold Corp.'s Pascua-Lama gold mine straddling the border with Argentina, but the court stopped short of ordering a re-evaluation of the environmental permit for the $8.5 billion project high in the Andes.
An indigenous community living below the mine had asked the Supreme Court to revoke Barrick's license and require the world's largest gold-mining company to prepare a new environmental impact study.
The Diaguita Indians, who accuse Barrick of contaminating their water downstream, earlier won an appellate ruling that ordered a freeze on construction of the project until the Toronto-based company builds infrastructure to prevent water pollution.
But they wanted to go further and had appealed that ruling from the court in the northern city of Copiapo in hopes of forcing Barrick to apply for a new permit that takes into account their anthropological and cultural claims to the watershed below the mine.
On Wednesday, the Supreme Court ruled the measures issued by the Copiapo Court "are sufficient to protect the constitutional guarantees that have been denounced as violated." The court also ordered "a suspension of the Pascua-Lama mining project" until environmental commitments and all works to protect the water systems are adopted. |

Court: Malpractice law covers doctors' businesses

Businesses formed by doctors are covered by a state law that caps the damages that victims of medical malpractice can collect from health care providers, New Mexico's highest court ruled Thursday.
The state Supreme Court said that medical professional corporations and limited liability companies fall under the law's definition of a health care provider under the state's medical malpractice law.
At issue was whether the 1976 law applied only to licensed physicians, hospitals, outpatient clinics and certain others such as chiropractors. A corporation established by a group of doctors for tax or business purposes isn't licensed, however.
The court said that excluding the businesses formed by medical professionals would undermine the purpose of the law, which was to increase the availability of insurance coverage for malpractice claims. The law was enacted after a large private insurer stopped offering malpractice coverage in the state.
The court said that "covering individuals without offering the same benefits to the companies that they form or operate under disturbs the balanced scheme originally set up by the Legislature that was intended to attract enough health care providers to service the needs of patients in New Mexico and, in turn, ensure that the patients were protected when claims for medical malpractice arise."
The court issued the ruling in deciding three separate malpractice lawsuits.
In 2011, Gov. Susana Martinez vetoed a measure passed by the Democratic-controlled Legislature that would have revised the malpractice law to increase its liability caps and make clear that the business organizations of doctors were covered.

Former Republican Party of Florida chairman Jim Greer pleaded guilty to theft and money laundering charges Monday just before jury selection in his criminal trial was to begin.
Greer pleaded guilty to four counts of theft and a single count of money laundering for funneling money from the Republican Party of Florida to a company he set up with his right-hand man. He could be sentenced to a minimum of 3 ½ years and a maximum of 35 years in prison at his March 27 sentencing.
The plea deal avoids would could have been an embarrassing trial for the state GOP. Some of Florida's most powerful politicians were scheduled as witnesses, including former Gov. Charlie Crist, former U.S. Sen. George LeMieux, former Florida Attorney General Bill McCollum and several state House and state Senate leaders.
"There were a number of people who did not want this trial to go forward and the trial isn't going forward," said Damon Chase, Greer's attorney. "Once again, Jim Greer is falling on his sword for a lot of other folks."
Topics that were covered in pretrial depositions included allegations of prostitutes at a state GOP fundraiser in the Bahamas, lavish spending on fancy restaurants and luxury hotels by state GOP leaders, the drinking habits of Crist and party leaders stabbing each other in the back.
"He has acknowledged he is guilty. That is what the party has wanted since the case started," said Stephen Dobson, an attorney for the Republican Party of Florida. |
