Post reporter charged in Iran after day in court

A Washington Post reporter detained in Iran for more than four months was formally charged Saturday after a day-long proceeding in a Tehran courtroom, the newspaper reported.
Jason Rezaian, the newspaper's bureau chief in Tehran since 2012, appeared in court almost five months after he was arrested July 22. The charges were the first against him since the arrest, the Post said. He is an Iranian-American who holds dual citizenship.
The newspaper, quoting a source familiar with the case, said the nature of the charges against him were not immediately clear to those not present in the courtroom. The State Department has repeatedly raised the subject of Rezaian and other Americans jailed in Iran during talks with the government about a deal to curb Iran's nuclear capacity and ease international sanctions.
The State Department tweeted early Sunday that Secretary of State John Kerry was "disappointed and concerned" with the latest developments and called on the Iranian government to drop any charges against Rezaian "and release him so he can be reunited with his family."
His detention has been extended to mid-January in recent days because the investigation is continuing, the Post said. |

Court kills New Jersey bid to block ocean blasting

A federal appeals court on Monday cleared the path for seismic testing off the coast of New Jersey that will blast the floor of the Atlantic Ocean with loud noises as part of a climate change research project.
The 3rd Circuit U.S. Court of Appeals rejected New Jersey's request to block the testing off Long Beach Island, which aims to use acoustic research to examine sediment dating back tens of millions of years. The barrier island stretches along the central New Jersey coast for about 18 miles.
Environmentalists, fishing groups and some elected officials oppose the work, saying it could harm or kill marine life including dolphins, turtles and whales. But the groups planning the research say they will do everything possible to minimize disruptions to marine life, including stopping the project when animals are seen nearby.
"Needless to say, we are extremely disappointed with this ruling and the fact that the federal government is pushing it at this time of year," said Larry Hajna, a spokesman for the state Department of Environmental Protection, which had sought a court order to block the testing. |

Miss. high court: Prisoner can get workers' comp

A former utility worker who lost his hands when he was shocked by power lines can receive workers' compensation, even though officials argued he tried to hurt himself to avoid a homicide investigation, the Mississippi Supreme Court has ruled.
Lonnie Smith pleaded guilty to manslaughter in the homicide case and is now serving a 12-year prison sentence. Smith, a former alderman in Ripley, Miss., was injured in April 2010 while working in a bucket-lift truck for the Tippah Electric Power Association.
In its 6-3 ruling Thursday, the Supreme Court ordered the Mississippi Workers' Compensation Commission to determine the benefits Smith should receive. The court's majority rejected the power association's claim that Smith intentionally grabbed the power lines to injure himself or commit suicide.
According to court records, no one could say they saw Smith grab the power lines in a deliberate manner. Smith said he got entangled in the wires after he dropped a knife in the bucket and reached down to get it.
A safety expert for Tippah testified the lines Smith allegedly grabbed were three feet, seven inches apart. The distance, the expert testified, would have made it difficult for Smith to accidentally touch both lines at the same time. |

CA Supreme Court justice to retire

The longest-serving current justice of the California Supreme Court announced Tuesday that she is retiring.
Justice Joyce Kennard notified Gov. Jerry Brown that she intends to step down on April 5, ending her 24-year tenure as a member of the state's highest court.
"The state and its people have been very well served by Justice Kennard," Brown said in a statement on Tuesday. "Her independence and intellectual fortitude have left a lasting mark on the Court."
Former Gov. George Deukmejian appointed Kennard to the Supreme Court in 1989, The San Jose Mercury News reported. She previously was a Los Angeles trial judge and an appeals court justice for a brief time before being elevated to the State Supreme Court.
Kennard, 72, has a unique personal history, according to the Mercury News, because she is a native of Indonesia, moved to the Netherlands as a teenager and lost part of her right leg to a tumor, forcing her to walk with a prosthetic the rest of her life.
Kennard moved to the United States in 1961, settling in Southern California. She earned her law degree from the University of Southern California.
In her tenure on the court, she became famous for interjecting questions during oral arguments, often turning them into lengthy speeches before pointing her finger at a lawyer and demanding an answer. Despite being an appointee of the conservative Deukmejian, she was often unpredictable in her rulings and would come down on the more liberal side of social issues before the court.
Kennard was in the 4-3 majority that in 2008 struck down California's long-standing ban on gay marriage, a ruling that preceded voter approval of Proposition 8 — which restored the same-sex marriage ban until the U.S. Supreme Court invalidated it last year. |
