France ponders removing risky breast implants

Emmanuelle Maria's breasts were burning and globules of silicone gel were protruding into her armpits. Her implants had exploded inside her. Yet her doctors, she says, told her nothing was wrong.
Now, she wants the French government to tell 30,000 women to get their implants removed — at the state's expense — to call attention to their risks and save others from potential pain and indignity.
Prompted by calls from implant wearers and leading doctors, French health authorities are considering a drastic and unprecedented move: recommending mass surgery to rid the country of a type of breast implant that investigators say was secretly made with cheap industrial silicone whose medical dangers remain unclear.
Governments around Europe are hanging on France's decision Friday. Tens of thousands more women in Britain, Italy, Spain and other European nations are walking around with the same pre-filled implants, made by the now-defunct French company Poly Implant Prothese, or PIP.
Health officials from several European countries held a conference call Wednesday to discuss the implants, Portugal's Director-General of Health, Dr. Francisco Jorge, told The Associated Press. European Commission spokesman Frederic Vincent said no decisions were made, but France informed the others of the situation. |

Pa.'s rhyming justice pens insurance fraud opinion

A state Supreme Court justice known for opinions written in rhyme has done it again, producing six pages of verse Thursday in the case of whether the maker of a forged check also had committed insurance fraud.
Justice J. Michael Eakin, writing for a 4-2 majority, concluded in six-line stanzas that a man's attempt to deposit a forged check appearing to be from State Farm didn't constitute insurance fraud.
Sentenced on the other crimes, he surely won't go free, but we find he can't be guilty of this final felony, Eakin wrote. Convictions for the forgery and theft are approbated -- the sentence for insurance fraud, however, is vacated. The case must be remanded for resentencing, we find, so the trial judge may impose the result he originally had in mind.
A dissenting three-page opinion by Justice Thomas G. Saylor didn't rhyme.
Eakin was first elected to the high court in 2001 after earning a reputation as the rhyming judge by issuing some opinions entirely in verse while sitting on an intermediate state appellate court in the late 1990s. Two former state Supreme Court justices, Stephen A. Zappala and the late Ralph J. Cappy, had expressed concern in the past that the practice could reflect poorly on the court. |

Int'l court refuses to halt Rwandan's release

International Criminal Court judges refused Monday to block the release of a Rwandan rebel prosecutors accuse of involvement in deadly attacks by a Hutu militia on villages in Congo in 2009.
The pre-trial judges ordered the release of Callixte Mbarushimana on Friday after dismissing all charges against him for lack of evidence. If he is freed, Mbarushimana would be the first suspect released from ICC custody since the court's inception in 2002.
Prosecutors had said they would appeal the ruling and asked the court to delay Mbarushimana's release pending the outcome of the appeal. But in Monday's written decision, judges ruled that Mbarushimana can no longer be detained because the 11 charges against him have been dismissed.
A warrant of arrest previously issued ceases to have effect with respect to any charges not confirmed by the Pre-Trial Chamber, the judges wrote. |

Suspect's lawyer describes Minn. courthouse attack

In the moments after authorities say a man just convicted in a criminal trial opened fire at a small northern Minnesota courthouse, it was his defense attorney who rushed to the aid of two shooting victims.
John Lillie III described a chaotic scene Thursday just minutes after his client, Daniel Schlienz, was convicted of third-degree criminal sexual conduct. Authorities have identified Schlienz, 42, as the man who shot the prosecutor who handled his case and another man.
In an interview with the Star Tribune of Minneapolis, Lillie said he was speaking to Schlienz's mother when he heard a shot ring out inside the Cook County courthouse.
Lillie said he followed a man's pleas for help and found Gregory Thompson, of Grand Marais, wounded. He dragged Thompson outside, then re-entered the courthouse to warn workers. Lillie said he heard two more shots on the second floor and ran up to find Tim Scannell, the county prosecutor, bleeding from three gunshot wounds. |

Wisconsin court accepts wind farm challenge

The state Supreme Court has agreed to decide whether Wisconsin regulators properly approved a huge wind farm in southern Minnesota.
Regulators in Wisconsin and Minnesota gave Wisconsin Power amp; Light permission in 2009 to build the $450 million farm just north of Albert Lea.
Two Wisconsin groups representing energy consumers contend the Wisconsin Public Service Commission should have applied stiffer approval criteria to the project. The commission has countered that such standards don't apply to out-of-state facilities.
The 4th District Court of Appeals asked the Supreme Court to take the case directly. Online court records indicate the high court has accepted the case, with the first briefs due in mid-January. |
