Governor signs bill to address prison court order

Gov. Jerry Brown has signed into law a compromise bill intended to ease the state's prison crowding crisis by asking federal judges to delay their year-end deadline for releasing thousands of inmates.
Brown announced his signing of SB105 without ceremony Thursday, a day after it was approved nearly unanimously by state lawmakers.
It authorizes the administration to spend a projected $315 million to lease cells in private prisons and county jails. Yet part of the money would instead go to rehabilitation programs if the court agrees to extend its deadline for reducing the prison population by about 9,600 inmates.
Brown and legislative leaders say they are hopeful, but there is no guarantee the court will agree. Inmates' attorneys say the proposal is vague and carries no guarantees of success. |

Chile OK's extradition bid for ex-US Navy officer

Chile's Supreme Court has approved an extradition request for a former U.S. military officer wanted in the 1973 killings of two Americans, including one whose disappearance was the focus of the movie "Missing," a lawyer said Wednesday.
Former U.S. Navy Capt. Ray E. Davis was charged last year in the deaths of journalist Charles Horman and student Frank Teruggi, who were killed during the 1973-1990 dictatorship of Gen. Augusto Pinochet.
Attorney Sergio Corvalan, who represents Horman's widow, told The Associated Press that the Supreme Court approved by a 4-1 vote a request by judge Jorge Zepeda to seek Davis' extradition to face trial in Chile.
A court official, who agreed to discuss the case only if not quoted by name, said the vote would be formally announced Thursday.
After Davis was charged a year ago, the AP contacted his wife, Patricia Davis, at her home in Niceville, Florida. She said her husband previously denied any involvement in killings. She said he no longer talked because of Alzheimer's disease and was in a nursing home that she declined to identify. |

High court won't block early voting in Ohio

The Supreme Court on Tuesday cleared the way for voters in the
battleground state of Ohio to cast ballots on the three days before
Election Day, giving Democrats and President Barack Obama's campaign a
victory three weeks before the election.
The court refused a request by the state's Republican elections chief
and attorney general to get involved in a battle over early voting.
Ohio is among 34 states, plus the District of Columbia, where people
can vote early without giving any reason. About 30 percent of the
swing state's total vote — or roughly 1.7 million ballots — came in
before Election Day in 2008. Crucial to Obama's win that year was
early voting in Ohio, North Carolina and Florida.
Obama won Ohio four years ago, but Republican rival Mitt Romney is
making a strong play for it this year. No GOP candidate has won the
White House without Ohio in his column.
Obama's campaign and Ohio Democrats had sued state officials over
changes in state law that took away the three days of voting for most
people but made exceptions for military personnel and Ohioans living
overseas.
Their lawsuit cited a recent study saying nearly 105,000 people voted
in the three days before the election in 2008, and they argued
everyone should have the chance to vote on those days. They also said
eliminating the opportunity for most Ohio residents to vote in person
on those days, while giving military or overseas voters the chance to
do so, leads to unequal treatment. |

Court upholds RI lawyer's corruption conviction

A federal appeals court has upheld the corruption conviction of a former North Providence town attorney who facilitated bribes to three town councilmen.
Robert Ciresi was convicted in April 2011 of bribery, extortion and conspiracy charges. The jury found he arranged and delivered a $25,000 bribe to then-Councilman John Zambarano after the town council rezoned a plot of land so a supermarket could be built there. Ciresi also helped put Zambarano in touch with a middleman on a separate $75,000 bribe related to a mill development.
Among other issues, Ciresi’s lawyers argued to the appeals court that the lower court incorrectly allowed prosecutors to play for the jury audiotapes that were made of Zambarano discussing Ciresi’s role in the scheme, arguing it constituted hearsay evidence.
The 1st U.S. Circuit Court of Appeals on Friday disagreed and upheld the conviction, as well as Ciresi’s sentence of five years and three months in prison. |

N.Y. probing equity firms, including Bain

New York's attorney general is investigating tax strategies of some of the nation's largest private equity firms, including Bain Capital, founded by Republican presidential nominee Mitt Romney, an official familiar with the probe said Sunday.
Attorney General Eric Schneiderman is examining whether the firms have abused a tax strategy to avoid paying hundreds of millions of dollars in taxes, said the official, who spoke on the condition of anonymity because of the sensitivity of the probe. The practice involves converting some fees collected for managing accounts into fund investments, resulting in a lower tax rate.
Some tax experts who spoke to The New York Times, which first reported the investigation Sunday, believed the strategy was potentially illegal, though other experts said it was commonplace and proper.
The Democratic attorney general sent subpoenas to more than a dozen firms, including Kohlberg Kravis Roberts & Company, TPG Capital, Sun Capital Partners, Apollo Global Management, Silver Lake Partners and Bain Capital, according to the official.
