UK court says income threshold for foreign spouses is lawful

Britain's Supreme Court says the government is entitled to set a minimum-income threshold for people wanting to bring foreign spouses to the country, a measure introduced to ensure immigrants won't draw on public welfare funds.
But the court says the way the rules have been implemented is unlawful.
Since 2012, Britons who want to bring spouses from outside the European Union to the U.K. must earn at least 18,600 pounds ($23,000) a year.
Several people who were rejected under the rules took the government to court, arguing the law breached their right to a family life.
The judges ruled Wednesday that the income requirement was lawful but had been implemented in a "defective" way.
They said authorities must consider the welfare of children and whether applicants have other funding sources.

Arkansas Court Upholds Gay Marriage Birth Certificate Law

Arkansas' highest court on Thursday threw out a judge's ruling that could have allowed all married same-sex couples to get the names of both spouses on their children's birth certificates without a court order, saying it doesn't violate equal protection "to acknowledge basic biological truths."
The state Supreme Court also issued a rare admonishment to Pulaski County Circuit Judge Tim Fox, saying he made "inappropriate remarks" in his ruling that struck down the birth certificate law. Fox had cited the U.S. Supreme Court's decision legalizing gay marriage in his ruling last year that said married same-sex couples should have both names listed on their children's birth certificates, just as heterosexual married couples do, without requiring a court order.
In the state Supreme Court's decision Thursday, the justices sided with the state attorney general's office, saying Arkansas has a vested interest in listing biological parents on birth certificates.
"What is before this court is a narrow issue of whether the birth-certificate statutes as written deny the appellees due process," Justice Josephine Linker Hart wrote in the court's majority opinion. "...In the situation involving the female spouse of a biological mother, the female spouse does not have the same biological nexus to the child that the biological mother or the biological father has. It does not violate equal protection to acknowledge basic biological truths."
Cheryl Maples, who sued on behalf of three same-sex couples, said she hasn't decided yet whether to appeal to the U.S. Supreme Court. The three couples who sued were allowed to amend their children's birth certificates last year under a ruling issued by Fox. |

Delaware County creates domestic violence court

The Indiana Supreme Court has approved the creation of a domestic violence court in Delaware County.
Delaware County Prosecutor Jeffrey Arnold tells The (Muncie) Star Press all felony domestic battery cases now will be filed in Delaware Circuit Court 1, where Judge Marianne Vorhees presides.
Arnold says the judge volunteered to create the domestic violence court. He says when one judge brings a lot of expertise to a legal area, it creates consistency.
Arnold recently has added a deputy prosecutor, an investigator and a victim advocate to deal exclusively deal with domestic violence cases.
Arnold says Vorhees will continue to preside over other types of criminal cases. |

Lithuania wants Gorbachev to testify in war crimes trial

A Lithuanian court has called former Soviet leader Mikhail Gorbachev to testify in a mass trial related to the 1991 crackdown on the country's independence movement.
Gorbachev and Russian authorities haven't answered previous requests so it's unlikely he would comply with Monday's request from the Vilnius district court.
The case involves more than 60 former Soviet officials charged with war crimes and other offenses for their roles in a crackdown on pro-independence demonstrators that left 14 people dead in January 1991, when Gorbachev was still in power.
The judges approved a request by one of the plaintiffs in the case to call Gorbachev to the court as a witness.
Only two defendants are present in court. Others, mainly citizens of Russia, Ukraine and Belarus, are being tried in absentia.

Former Ohio officer charged with murder due back in court

A former college police officer charged with murder in the fatal traffic-stop shooting of a black man is due back in court.
Hamilton County Common Pleas Judge Megan Shanahan set a Friday pretrial hearing, ahead of the planned start of jury selection on Oct. 25.
Twenty-six-year-old Ray Tensing faces charges of murder and voluntary manslaughter in the July 2015 shooting of 43-year-old Sam DuBose. The white officer, who has since been fired by the University of Cincinnati, pulled DuBose over near campus for a missing front license plate.
Tensing has pleaded not guilty. His attorney has said that his client feared being dragged under the car as DuBose tried to drive away.
Tensing is free on $1 million bond and hasn't attended earlier pretrial hearings this year. |
