UN court lays down Costa Rica, Nicaragua maritime borders

The International Court of Justice laid down definitive maritime boundaries Friday between Costa Rica and Nicaragua in the Caribbean Sea and Pacific Ocean and a small land boundary in a remote, disputed wetland.
As part of the complex ruling, the United Nations' highest judicial organ ruled that a Nicaraguan military base on part of the disputed coastline close to the mouth of the San Juan River is on Costa Rican territory and must be removed.
Ruling in two cases filed by Costa Rica, the 16-judge U.N. panel took into account the two countries' coastlines and some islands in drawing what it called "equitable" maritime borders that carved up the continental shelf underneath the Caribbean and Pacific.
Such rulings can affect issues including fishing rights and exploration for resources like oil.
Earlier, the court ordered Nicaragua to compensate Costa Rica for damage Nicaragua caused with unlawful construction work near the mouth of the San Juan River, the court's first foray into assessing costs for environmental damage.
The order by the United Nations' principal judicial organ followed a December 2015 ruling that Nicaragua violated Costa Rica's sovereignty by establishing a military camp and digging channels near the river, part of a long-running border dispute in the remote region on the shores of the Caribbean Sea.
In total, Nicaragua was ordered to pay just over $378,890 for environmental damage and other costs incurred by Costa Rica— a small fraction of the $6.7 million sought by San Jose.

Court eyes Massachusetts church-state dispute

An attorney says a Massachusetts town should not be barred from giving public funds to support the restoration of a historic building just because it happens to be a church.
Nina Pickering-Cook told Massachusetts' highest court on Thursday that communities' ability to protect their historic resources shouldn't change because the structures are owned by a religious entity.
At issue is whether the town of Acton violated Massachusetts' constitution when it approved more than $100,000 in community preservation grants to restore stained-glass windows and identify other needs at a church.
Douglas Mishkin is an attorney for the taxpayers who brought the lawsuit. Mishkin told the court that active houses of worship are clearly prohibited from getting taxpayer dollars.
The Supreme Judicial Court is expected to rule in the coming months. |

German court orders sentence enforced in Chile abuse case

A court in western Germany has ruled that a German man must serve the sentence of a Chilean court for his role in the sexual abuse of children at a secretive German colony in Chile.
The dpa news agency reported Monday that the court in the town of Krefeld said Hartmut Hopp must serve in Germany the five-year sentence given to him by a Chilean court in 2011 for 16 counts of aiding in the sexual abuse of children.
The crimes took place at the Colonia Dignidad enclave, where residents were physically and psychologically abused for three decades beginning in 1961 after moving there from Germany.
Hopp fled to Germany before the verdict took legal effect. The 73-year-old denies the charges and his attorney says he will appeal the ruling.

NJ Supreme Court Reverses Decades-Old Divorce Law

The New Jersey Supreme Court has reversed a decades-old law in a landmark decision that makes the child the focus of divorce relocation proceedings.
The law centers on divorced parents who want to leave New Jersey with the child against the other parent's wishes.
NJ.com reports the previous law focused on whether the move would "cause harm" to the child. After Tuesday's ruling, divorced parents now must prove the move is in the child's best interest.
The decision centers on a 2015 case where a father tried to keep his daughters from moving to Utah with his ex-wife. The attorney for the father says the ruling will make a large impact in future proceedings.
The attorney for the children's mother has not responded to requests for comment.

Federal court's agenda has topics that draw Trump's ire

The nation’s largest federal court circuit has clashed repeatedly with President Trump over the past six months, and the agenda for its annual meeting is not shying away from topics that have stoked the president’s ire.
Immigration, fake news and meddling in the U.S. election are among the subjects to be discussed or touched on at the four-day conference of the 9th Circuit courts in San Francisco starting Monday.
Judges in the circuit have blocked both of Trump’s bans on travelers from a group of mostly Muslim countries and halted his attempt to strip funding from so-called sanctuary cities.
Trump has fired back, referring to a judge who blocked his first travel ban as a “so-called judge” and calling the ruling that upheld the decision disgraceful. Republicans have accused the 9th Circuit appeals court of a liberal slant and renewed efforts to break it up — a move Trump supports.
The 9th Circuit’s spokesman, David Madden, acknowledged that someone could see a connection between the conference agenda and the administration, but he said there was no intention to link the two. |
