Court officer investigated for photographing lawyer's notes

A court security officer in Maine has been placed on leave while under investigation for sending a cellphone photo of a defense attorney's notes to a prosecutor.
The Kennebec Journal reports that court officials are calling the incident a serious ethical breach and violation of courtroom protocol.
Sgt. Joel Eldridge took the photo Tuesday as a judge and attorneys discussed a case involving robbery, aggravated assault and criminal mischief. Assistant District Attorney Francis Griffin told the judge he saw the photo on his phone and reported the incident to the district attorney.
Defense attorney Sherry Tash said she was told the photo showed her notes of a person's name and number. Eldridge declined comment. He's on administrative leave with pay pending an internal investigation by the Kennebec County Sheriff's Department.

Appeals court: Week of early voting shouldn't return to Ohio

A federal appeals court on Tuesday upheld an Ohio law that trims a week of early voting in the swing state, reversing a judge's decision that had restored the time.
Democrats had challenged a series of Republican-backed voting changes they claimed disproportionately burdened black voters and those who lean Democratic. Among the policies was the elimination of early voting days in which Ohioans could also register to vote, a period known as golden week.
The state's attorneys argued that scrapping the days helped alleviate administrative burdens for local elections officials while reducing costs and the potential of fraud. But plaintiffs, who include the state's Democratic Party, said the burden on voters outweighed any benefit to the state.
In a 2-1 decision, a panel of the 6th U.S. Circuit Court of Appeals in Cincinnati ruled the golden-week cut still allows for "abundant" opportunities to vote within a 29-day window. Prior to the law, Ohioans had a 35-day period.

Appeals court delay requested in ex-Virginia governor's case

Prosecutors have asked a federal appeals court to delay action for 30 days on a U.S. Supreme Court ruling in former Virginia Gov. Bob McDonnell's corruption case — to allow both sides time to analyze it.
The Richmond Times-Dispatch reportsthe U.S. Attorney's Office said the motion filed jointly Thursday proposes that parties file a briefing schedule or update the 4th Circuit Court of Appeals on discussions after 30 days.
McDonnell was convicted in 2014 of doing favors for a wealthy businessman in exchange for more than $165,000 in gifts and loans.
The Supreme Court overturned McDonnell's conviction in June, saying his actions were distasteful but didn't necessarily violate federal bribery laws. The case was returned to the lower court to decide whether there's enough evidence for another trial.

Spain court orders Operation Puerto blood bags released

A Spanish court ruled Tuesday that blood bags that are key evidence in one of Spain's worst doping scandals should be handed over to authorities for investigation.
The Madrid Provincial Court said bags containing blood samples and plasma should be handed over to the Spanish Cycling Federation, the World Anti-Doping Agency, the International Cycling Union and Italy's Olympic Committee.
The announcement came 10 years after Operation Puerto revealed a doping network involving some of the world's top cyclists when police seized coded blood bags from the Madrid clinic of sports doctor Eufemiano Fuentes.
The decision backed an appeal by lawyers for prosecuting parties against a 2013 court ruling that the bags should be destroyed for privacy reasons.
The court said Thursday's ruling "took into account that the goal is to fight against doping, which goes against sport's ethical values."
Not ordering the bags to be made available would have "generalized the danger of other sports people being tempted to dope themselves and sent a negative social message that the end justifies the means," the court said.
The 2013 order to destroy the blood bags outraged the sports community. Spain's anti-doping agency, the International Cycling Union and the World Anti-Doping Agency were among the entities that appealed.

Teen changes plea to guilty in deaths of mother, stepfather

A northern Wisconsin woman changed her plea to guilty Friday in the slaying of her mother and stepfather in a deal that has prosecutors recommending a 40-year prison sentence.
Ashlee Martinson, who was 17 at the time of the March 2015 killings, faces two counts of second-degree homicide, USA Today Network-Wisconsin reported. She had earlier pleaded innocent by reason of insanity in the killings at the family's home near Three Lakes.
According to court records filed Friday, Martinson told police she shot her stepfather, 37-year-old Thomas Ayers, in the neck and head. She then went to her mother, 40-year-old Jennifer Ayers, for solace, but her mother first tried to aid her husband, then armed herself with a knife to confront Martinson.
Martinson wrestled the knife from her mother and stabbed her more than 30 times. She then went downstairs and turned the family TV to show cartoons to her three sisters, ages 2 to 9. After showering, Martinson confined the younger girls in a room before fleeing to Indiana with her boyfriend, documents show.
Court documents say the Ayerses were killed the same day they warned Martinson's 22-year-old boyfriend to stay away from her because she was a minor.
Martinson told authorities she had been mentally and verbally abused by her stepfather and had seen him physically abuse her mother and siblings, according to court records.
The assessment also said Martinson had suffered from depression on and off since age 8, gaining in intensity at age 15. Martinson's sentencing is set for June 17. |
